The Family Medical Leave Act (FMLA) obligates districts to provide eligible employees with unpaid leave of up to 12 weeks annually while the Americans with Disabilities Act (ADA) obligates districts to provide reasonable accommodations to qualified individuals with disabilities, unless doing so would cause an undue hardship. This presentation provides an overview of a district’s obligations under both the FMLA and the ADA, and analyzes recent trends with respect to leave entitlement and accommodations in the evolving modern workplace and how the two Acts can often overlap.
Further, this presentation covers additional employee leave rights, including pregnancy related absences under the Illinois School Code, Family Bereavement Leave, and other statutory leave rights.
